Legal interventions in the development approvals process to date in Jamaica provide a welcome evidentiary basis to promote reform aimed at reinforcing the procedural rights of citizens. Legislation will lessen the discretion given to state authorities and ensure increased public participation during the process. However, the absence of meaningful reform in the development approvals process will result in an exponential increase in legal challenges where property rights are perceived to have been compromised.
